<br />2.3 It is the policy of the City of Roseville to grant minor variances for driveway side <br />yard setback.s when nonconforming driveways are replaced, provided the property <br />is located in an R-1, Single Family Residential District, and used for residential <br />purposes. It is also the policy of the City of Roseville to issue minor variances when <br />there is a hardship or practical difficulty, provided the property is located in an R-1, <br />Single Family Residential District, and used for residential purposes. <br /> <br />2.4 Section 703.04(8)(9), City Code, states "residential driveways shall be constructed <br />so that the edge of the driveway nearest to the side lot line shall be a minimum of <br />five feet from the side lot line." <br /> <br />3.0 MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, a sketch of the <br />property and driveway, a written statement from the applicant, and written approval <br />from the adjacent property owner affected by the variance (Nan Tu at 2008 Wheeler <br />Street North). <br /> <br />3.2 The Minor Variance Committee reviewed this request on Monday, June 1, 1998. <br />Mr. Johnson was present to present his proposal and answer questions. The <br />project was discussed, including the hardship created by the location of the house, <br />the fact that this request was for a replacement driveway/parking area, and the <br />practical difficulty of the single car garage. The failure to obtain a building permit <br />for the replacement driveway/parking area was also discussed, with Mr. Johnson <br />agreeing to appJy for a permit after the fact. The driveway/parking area will not <br />create any drainage problems if it is widened to the property line. Alternative <br />locations for a parking area were also discussed, with the Minor Variance <br />Committee concurring that the driveway/parking area as proposed is the best <br />option from both a functional and aesthetic standpoint. <br /> <br />3.3 The Minor Variance Committee unanimously recommended approval of a minor <br />variance to reduce the side yard setback of a driveway/parking area to less than <br />one foot (1011) for the purpose of replacing a driveway/parking area at 2000 Wheeler <br />Street North, based on the following findings: <br /> <br />1. Section 703.04(8)(9) of the City Code requires a residential driveway to be <br />set back a minimum of five feet from the side property line. <br /> <br />2. The location of the house on the property creates a physical hardship for the <br />applicant, while the single car garage presents a practical difficulty for the <br />applicant. <br /> <br />3.
