2.5 Section 1012.09 of the City Code outlines the provisions for interim uses. An interim
use is not required to be consistent with the land use designation identified in the
Comprehensive Plan, nor is it required to meet all of the zoning standards
established for the district in which it is located. In reviewing a request for an interim
use permit, the City may attach conditions and will establish a specific date or event
that will terminate the use on the property. In granting an interim use permit, the
City Council must also determine that the approval of the interim use permit will not
result in adverse impact on the public health and welfare, that the operation is safe
to the public, and that there are no additional costs added to the site that would
deter a permanent use at a later time.

3.0 STAFF COMMENT

3.1 In reviewing this request, staff made the following findings:

~1.

The continued use of the existing temporary building for an additional t~ree
years will not have an adverse impact on the public health and welfare.
~ ' ~

~2.

The continued use of the existing temporary building for an additional three
years will ~e a threat to the public sai~.

...",.

> 3.

The continued use of the existing temporary building for an additional three
years will not deter a permanent use at a later time.
I!:::= -=\I

4.0 STAFF RECOMMENDA TION

4.1 Based on the findings outlined in Section 3.1 of this report, staff recommends
approval of the request for a three-year extension of an interim use permit to allow
the continued use of one 24' x 70' temporary building for office space at 2701 Rice
Street North, with the following conditions:

1.
