<br />~ <br /> <br />B. Procedure For MiHor 'lariaFlee Setback Permit. An owner of land may file an application for a <br />miflor variance setback permit as defined in subsection 1 below by paying the fee set forth in <br />Section 1014.03 of this Title and providing a completed application and supporting documents as <br />set forth by the Community Development Department. The application shall then be referred to <br />the MiRor Variance Board Development Review Committee as set forth in subsection 2 of this <br />Section. In the event that the Board Committee and contiguous property owners unanimously <br />approves recommend approval of said '.'ariance setback permit, the '/ariaFlee setback permit may <br />be graRted issued by the City COI:IReil Community Development Director. In the event the <br />applicatioR setback permit is not unaRimololSly approved issued by the &affi Community <br />Development Director, or if the applicant does not find the conditions placed on such a permit per <br />subsection 1013 .05(B)(1 0) acceptable, the applicant may proceed as provided in sl:lbseetioR B of <br />tlHs Section 1013.02, and the original fee shall be applied to the fee as required for a variance. <br /> <br />.L A "minor variance" "setback permit" is a variance to reduction of the front, side or rear <br />yard setbacks of principal and accessory structures in either R-l or R-2 Districts or to the <br />Ron motorized pathway requiremeRts of SeetioFl 1012.07 of this Title, or to the residential <br />driveway wfQtR. restrictions in subsection 703.04B of this Code. <br /> <br />2. The MiFlor VariaFlce Board Development Review Committee shall be composed of tHe <br />CHief Code ERforeemeFlt Offieer, tHe Community DevelopmeRt Direetor (or aesigA(~e), <br />tHe Pl:lblie Works Director (or designee), tHe City Manager (or designee). appointed by <br />the City Manager and shall include the Community Development Director. For the <br />purpose of setback permit review and recommendation, the Development Review <br />Committee shall be advisory to the Community Development Director. The Community <br />Development Director (or designee) may also request review of applications from other <br />City departments or public agencies. (Current members of the Development Review <br />Committee include the Community Development Director, Chief Code Enforcement <br />Officer, Public Works Director (or designee), City Manager (or designee), City Planner, <br />Park & Recreation Director (or designee), Police Chief (or designee, and Fire Marshal.) <br /> <br />lo Before tHe MiFlor '/ariance Board may eORsider Sl:IeR miFlor variaRce applieatioR, the <br />applieaRt sHall seeure aRd present written statemeFlts from OWRers of property cORtigl:lol:ls <br />to the affected yard for ',>,'Hieh the '/ariaFlee is reql:lestea, specifically notiRg whetHer tl:1ere <br />is objectioR aFld eonseRtiRg or dissentiRg to sHch miRor variaRee. The Community Development Director (or designee) shall, in writing, seek <br />comment from contiguous property owners before considering a request for a setback <br />perm it. <br /> <br />4. The Minor Variance Board Communit Develo ment Director or d sin ee shall <br />schedule an administrative hearing before the Development Review Commi ee, the time <br />and place for which shall be set by the City MaFlager Community Development Director <br />(or designee). The applicant and contiguous property owners to tHe affected yard shall be <br />notified by the Community Development Director (or designee) of such time and place in <br />writing not less than five (5) days prior to such hearing. The City MaRager Community <br />Development Director (or designee) may inform additional property owners as the City <br />Manager may feel merit an interest iR the proceedings if a determination is made that <br />such additional notification is merited. <br /> <br />Ordinance 1215-Page20f4 <br />
