<br />~ <br />. dncx <br />.~~ <br /> <br />CJ <br /> <br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />DATE: 10/26/98 <br />ITEM NO: J-2 <br />City ~e;'-APproval: Agenda Section: <br />ORDINANCES <br />City of Roseville proposed text amendments to the City Code <br />Regarding Minor Variances and Setback Permits (PF3047) <br /> <br /> <br />1.0 REQEUSTED ACTION <br /> <br />1.1 The City Council requested the Planning Commission and staff to recommend <br />amendments to the City Code regarding minor variance procedures and establish <br />an alternative procedure to reduce setbacks in residential areas. The Council <br />considers approximately 50 minor variances and blanket minor variances annually <br />(usually setback issues), and would like an alternative to the current procedure that <br />requires a finding of physical hardship under State Statutes. The Council would <br />also like to establish a procedure that encourages residential property owners to <br />continue investing in and upgrading their properties, while taking practical hardship <br />into consideration. Council members have asked for clarification of Code language, <br />more consistency in the reviews of variance requests, and establishment of a <br />streamlined process that reduces time and cost for the applicant. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 In responding to the City Council's request, staff proposed the following alternatives: <br /> <br />1. Create a setback permit procedure for residential properties in R-1 or R-2 <br />zoning districts, which eliminates the need for a public hearing and a finding <br />of physical hardship. This procedure would also establish criteria for the <br />consideration of a setback permit and eliminate the minor variance <br />procedure. (The attached ordinance uses this alternative). <br /> <br />2. Reduce the setback requirements for R-1 and R-2 zoning districts for specific <br />types of encroachments, such as porches, garages, driveways, and additions <br />to the rear of the homes. These new setbacks would apply to all of the R-1 <br />and R-2 zoning districts within the community, and would allow lesser <br />setbacks through the building permit process. Any reduction in setback <br />beyond these provisions would require a variance and a physical hardship <br />would need to be clearly demonstrated. <br /> <br />3. Redefine physical hardship as it applies to variances from the provisions of <br />the zoning code. This may require new state legislation and changes to <br />State Statutes, as well as changes to the Roseville City Code. <br /> <br />PF3047 - RCA (10/26/98) - Page 1 of 3 <br />
