<br />e. The existing improvements along with new improvements retain a <br />minimum of 65% of the pervious surface and green space of the lot. <br />f. The permit creates no other setback or variance conditions. <br />g. The proposed addition improves the aesthetics, covered storage, or the <br />functional use of the site. <br />h. Uses the same exterior structure materials and colors as the principal <br />structure and accessories. <br />i. The building mass is consistent with those adjoining. <br />j. The building or driveway expansion does not place more vehicles <br />adjacent to living quarter first floor bedrooms of adjacent home owners. <br />k. The drainage and roof gutters guide water away from the structure and <br />adjacent structures. <br /> <br />5. A setback permit shall not reduce the principal structure side yard required setback by <br />more than 70% or be closer than three (3) feet to a property line. <br /> <br />6. A setback permit shall not reduce the principal structure front or rear yard required <br />setback by more than 20% or be closer than twenty-four (24) feet to a front or rear <br />property line. <br /> <br />7. A setback permit shall not reduce the accessory structure side or rear yard required <br />setback by more than 70% or be closer than three (3) feet to a property line. <br /> <br />8. The Development Review Committee may add conditions which mitigate the impact of <br />reduced setback to the issuance of a setback permit. <br /> <br />9. Appeals of the Development Review committee administrative decision may bemade to <br />the City Council utilizing the variance procedure (Section 1013.02 A,B). If the <br />requirements listed in this Section cannot be achieved by the applicant, the variance <br />process (Section 1013.02 A,B) shall apply. <br /> <br />10. All encroachments greater than those described in this Section shall adhere to the <br />variance process (Section 1013.02 A,B) and shall have a demonstrated hardship as <br />defined by State Statute. ! <br /> <br />11. The Mir:lgr \I:uiar:l~g Qg:;u;g Development Review Committee may r:8~9R::II=R8Rg dppr9Hal <br />approve of a FRir:lgr "driar:l~8 an expansion, reduction, or setback of a driveway wiQU:I. as <br />outlined in subsection 703.04B of this Code when, in the judgment of the Mir:lgr Vd~iaRSg <br />~ Committee, one or more of the following conditions exist relative to the driveway: <br /> <br />a. Unsafe conditions due to motor vehicle speed or volume on or the site <br />distance from the adjacent roadway. <br />b. An unusually short distance from the roadway to the garage or other <br />circumstances that prevent normal maneuvering of motor vehicles within <br />the subsection 703.04B, of this code, width restrictions. <br />c. The existing nonconforming driveway provides unique structural support <br />to adjacent lands or facilities. <br /> <br />d. Other unusual conditions that would result in 8xtr8FR8 a practical <br />hardship absent the requested minor variance. (ord.1176.11-25-1996) <br />
