The existing nonconforming driveway provides unique <br />structural support to adjacent lands or facilities. <br /> <br />d. Other unusual conditions that would result in extreme hardship <br />absent the requested minor variance. (Ord. 1176, 11-25-1996) <br /> <br />1012.02: REQUIRED YARDS AND OPEN SPACE: <br /> <br />A. Reduction Of Space Below Minimum Requirement Forbidden: No lot, yard or <br />other open space shall be reduced in area or dimension so as to make such lot, yard <br />or open space less than the minimum required by this Title, and if the existing lot, <br />yard or other open space as existing is less than the minimum required, it shall not <br />be further reduced. No required open space provided about any building or structure <br />shall be included as a part of any open space required for another building or <br />structure. (Ord. 275, 5-12-1959) <br />B. Certain Structures Not Considered Encroachments: The following shall not be <br />considered as encroachments on yard setback requirements: . <br />1. Chimneys, flues, belt courses, leaders, sills, pilasters, lintels, ornamental <br />features, cornices, eaves, gutters and the like provided they do not project more than <br />three feet (3'). (Ord. 275, 5-12-1959) <br />2. Terraces, steps, uncovered porches and patios, decks, stoops or similar <br />features provided they do not extend above the height of the ground floor level of the <br />principal structure or to a distance less than two feet (2') from any lot line except that <br />patios shall not be less than ten feet (10') from a street right of way. Fences in front <br />yards which do not exceed four feet (4') in height. <br />3. Side Or Rear Yard Only: Bays not to exceed a depth of three feet (3') or <br />contain a gross area of more than thirty (30) square feet, fire escapes not to exceed <br />a width of three feet (3') and fences or walls not to exceed a height of six and one- <br />half feet (6 1/2') above grade except that in B or I Districts or on property lines in <br />other districts abutting B or I Districts, fences or walls shall not exceed eight feet (8') <br />above grade. (Ord. 878, 3-23-1981; amd. 1995 Code) <br />4. Rear Yard Only: Balconies, breezeways, detached outdoor picnic shelters <br />and recreational equipment. (Ord. 275, 5-12-1959) <br />C. Fences: <br />1. Location: Fences, when constructed to enclose any lot or tract of land, shall <br />be located in such a way that the entire fence shall be on the property of the builder <br />thereof. Posts and framework shall be placed within the property lines of the owner <br />and the actual fencing material such as wire, lumber, pickets, etc. shall be placed on <br />the side of the fence which faces the street or the adjacent property. (1990 Code) <br />2. Barbed Wire Fences Prohibited: No fence constructed with or using barbed <br />wire shall be permitted in any R District or on any property line which abuts <br />an R District.
