In order to <br />include Ordinance No. 1215 (adopted November 9, 1998) into the City Code, text <br />clarification and technical corrections are necessary. The text corrections include linkages <br />to and references for other sections in the Code. There are no substantive language <br />changes. The simplest method was to restate the entire ordinance with text corrections <br />and language clarification included. <br /> <br />1.2 The setback permit procedure encourages residential property owners to continue <br />investing in and upgrading their properties, while taking practical hardship into <br />consideration. The setback permit procedure as established in the ordinance reduces turn <br />around time of requests, eliminates the need for public hearings and a finding of physical <br />hardship and reduces the cost to residents, all while adding the flexibility needed to <br />respond to Roseville's livable community goals. The ordinance eliminates the minor <br />variance procedure and all references to minor variances throughout the code. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 In 1998, the City Council requested the Planning Commission and staff to recommend <br />amendments to the City Code regarding minor variance procedures, and to establish an <br />alternative procedure to reduce setbacks in residential areas. The Council considers <br />approximately 50 minor variances and blanket minor variances annually (usually setback <br />issues), and would like an alternative to the current procedure that requires a finding of <br />physical hardship under State Statutes. In responding to the City Council's request, staff <br />proposed several alternatives, including the creation of a setback permit procedure. <br /> <br />3.0 STAFF RECOMMENDATION <br /> <br />3.1 Staff recommends approving the clarification and restatement of the ordinance (No. 1215) <br />amending the Roseville City Code to create an administrative setback permit procedure, <br />eliminate the minor variance procedure, and eliminate references to minor variances <br />throughout the code, as detailed in the attached ordinance. <br /> <br />PF3047 - RCA (06/14/99) - Page lof2 <br />
