At the March 23, 1998, City Council <br />meeting, the Council directed staff to work with the City Attorney on the interpretation of <br />the City Code regarding the location of dry cleaning service facilities. It was the <br />recollection of Council members Goedeke and Wiski that the City Code was amended in <br />1987 to allow dry cleaning service facilities (ie. modern dry cleaning operations) as a <br />permitted use in most business zones. <br /> <br />The attached opinion from Mitch Converse indicates that a dry cleaning service facility as <br />defined in the City Code is a permitted use in a B-2 zoning district, provided the six criteria <br />set forth in the definition are satisfied. Lexington Plaza is within a B-2 zoning district. <br /> <br />Don Frishberg, owner/operator of Grand Cleaners, has signed an affidavit of compliance <br />stating that the operation of Grand Cleaners complies with the six criteria included in the <br />definition of dry cleaning service facility. Early next week, City building inspection staff will <br />inspect the operation to verify compliance with these provisions. If a determination is made <br />that the operation does comply with the six criteria, a building permit will be issued and the <br />operation will be allowed to relocate to Lexington Plaza. <br /> <br />Let me know if you have any questions or need additional information. <br /> <br />M:\KIM\M_DEND3 <br />
