8-fd--qfJ'

EXCERPT FROM PLANNING COMMISSION MINUTES OF 8/12/98:

6d. Planning File 3053. Robert Schroeder is requesting variances to reduce
the setback from the ordinary high water level of McCarrons lake to 10'
and the front yard setback to 27.5' for the purpose of constructing a 12' x
32' addition on a non-conforming residential structure at 257 South
McCarrons Boulevard.

Member Harms opened the public hearing and requested Dennis Welsch
present a summary, based on written reports dated July 8,1998, of the
application for variances by Robert Schroeder, 257 South McCarrons Boulevard.

Dennis Welsch discussed Mr. Schroeder's request for a 12' x 32' addition to the
pre-existing non-conforming architecturally designed home. He indicated
ordinary high water level setback variance of 65'; front yard variance (from
McCarrons Lake) of 2.5'; that the addition was on the southwest corner of the
building and would be constructed to conform to handicap accessability.

The applicant, Bob Schroeder, presented his architect, Matt Dean, 634
Minnesota Building, St. Paul. Member Mulder asked if existing roofline would be
followed? (yes). Member Klausing asked if the same building materials as the
existing house would be used for addition (yes).

There being no further questions or comments, Chair Harms closed the hearing.

Motion: Member Rhody moved, Member Wilke seconded, to recommend
approval of the request for a variance from Section 1011.02 to allow the
construction of a 12' x 32' addition to a non-conforming residential structure on a
lakeshore lot at 257 McCarrons Boulevard, based on the following staff findings
and pending approval from the Minnesota Department of Natural Resources, and
with the following provision:
A plan for adding vegetative screening on the house from Lake
McCarrons must be submitted to the City for review in conjunction with the
plans for a building permit, and such vegetation must be installed in
conjunction with construction of the addition.

Findings:
1)

Section 1016.16 of the City Code requires a setback of 75 feet from
the ordinary high water level of McCarrons Lake. For this reason,
the existing structure on the property is nonconforming because it
is only setback 10 feet from McCarrons Lake.

2)

Section 1011.02 of the City Code does not allow the expansion of a
non-conforming structure, although Section 1016.22 does allow
additions to non-conforming lakeshore lots if the addition meets the
