<br />'8- t.). ~q ~ <br /> <br />EXCERPT FROM PLANNING COMMISSION MINUTES OF 8/12/98: <br /> <br />6h. Planning File 3055. Peter Kelsey and Greta Friedemann are requesting <br />variances to reduce the setback from the ordinary high water level of Walsh <br />Lake to 37.5' and to reduce the front yard setback to 20' for the purpose of <br />establishing a building pad on a new lot at 1935 Lake Street. <br /> <br />Chair Harms opened the hearing and requested Dennis Welsch present a summary, <br />based on written reports dated July 8, 1998, of the request for variances at 1935 <br />Lake Street, indicating a shoreland variance of 9' and a front yard variance of 10' <br />was being requested. He advised the building pad being requested was in line with <br />other homes; discussed the hardship and recommended approval with DNR <br />comments (which is a 60-day time period). <br /> <br />Applicant, Peter Kelsey, 401 South First Street, #1010, Minneapolis, advised he <br />would build a walk-out style home on the lot. <br /> <br />John Abler, owner of property south of the subject lot, expressed concern that <br />the DNR comments were not available. <br /> <br />The Commission received a note from Lawrence Demares, 1955 Lake St., <br />indicating support of the request for a variance. <br /> <br />Member Mulder asked if the Kelsey lot to the north was a buildable lot of record. <br />Dennis Welsch advised the lot had been platted and (Council) approved, but it was <br />not recorded as a separate lot and not necessarily a buildable lot. <br /> <br />There being no further questions or comments, Chair Harms closed the hearing. <br /> <br />Motion: Member Mulder moved, Member Wilke seconded, to recommend approval <br />of Peter Kelsey and Greta Friedemann's request for variances to reduce the <br />front yard setback to 20 feet and the setback from the ordinary high water level of <br />Walsh Lake to 37.5 feet for the purpose of establishing a buildng pad, prior to <br />having a house designed for the parcel at 1935 Lake Street, based on the staff <br />findings and pending approval from the Minnesota Department of Natural <br />Resources, and with the following provisions: <br /> <br />1, The 37.5 setback area from the ordinary high water level of Walsh Lake must <br />be planted and maintained with natural vegetation. A walkway/open area not <br />exceeding 20 feet in width will be allowed between the building area and the <br />shoreline. The existing trees along the shoreline of the property must remain <br />in place to soften the visual impact of the house from Walsh Lake, <br /> <br />2, The impervious lot coverage of the parcel cannot exceed 25%. <br /> <br />3, Drainage of the proprty, including the driveway and roof gutters, should be <br />
