<br />. (a) Covenan~s, conditions, restrictions. declarations and easements of record. if any; <br />(b) Reservations of mineral rights by the State of Minnesota. if any; . <br />(c) Building, zoning and subdivision laws and regulations; and <br />(d) The lien of real estate taxes and installments of special assessments which are payable by <br />Purchaser pursuant to paragraph 6 of this contract. . <br /> <br />3. DELIVERY OF DEED AND EVIDENCE OF TITLE. Upon Purchaser's prompt and full <br />performance of this contract, Seller shall: <br /> <br />(a) Execute, acknowledge and deliver to Purchaser a Limited Warranty Deed. in recordable <br />form, conveying marketable title to the Property to Purchaser, subject only to the <br />following exceptions: <br /> <br />(i) Those exceptions referred to in paragraph 2(a), (b), (c) and (d) of this Contract; and <br /> <br />(ii) Liens, encumbrances, adverse claims or other matters which Purchaser has <br />created, suffered or permitted to accrue after the date of this contact. <br /> <br />(b) Deliver to Purchaser the abstract of title to the Property or, if the title is registered, the <br />owner's duplicate certificate of title. <br /> <br />4. PURCHASE PRICE. Purchaser shall pay to Seller, at the Roseville City Hall. 2660 Civic Center <br />Drive, Roseville, Minnesota 55113. or such other place designated by the Seller in writing. the sum <br />of FortyThousand Dollars ($40,000.00), as and for the purchase price for the Property, payable as <br />follows: <br /> <br />$39.400 cash on hand paid on the execution and delivery of this Contract; and <br /> <br />The further sum of $100.00 plus accrued interest payable upon the issuance by Seller of a <br />Certificate of Completion for the Property. Purchaser shall be entitled to a $500.00 credit for the <br />fee paid by Purchaser to the Seller under the City of Roseville Housing Replacement Program <br />Participation Agreement. The $500.00 credit shall be applied to the purchase price upon <br />fulfillment of Purchaser's obligations under this Contract. Notwithstanding anything contained <br />herein to the contrary, all amounts due and payable under this Contract shall be paid in full on or <br />before June 30.1999 ,without interest. <br /> <br />5. PREPAYMENT. Purchaser shall not prepay this Contract without the prior written consent of <br />the Seller. which consent shall be at the sole and exclusive discretion of the Seller. <br /> <br />6. REAL ESTATE TAXES AND ASSESSMENTS. Purchaser shall pay. before penalty accrues, all <br />real estate taxes and installments of special assessments assessed against the Property which are <br />due and payable in the year 1999 and in all subsequent years. Real estate taxes and installments <br />of special assessments which are due and payable in the year in which this Contract is dated shall <br />be paid as follows: The parties shall prorate said real estate taxes and installments of special <br />assessments between them as of the date of this Contract using a calendar year basis. <br /> <br />. '- <br /> <br />Seller warrants that the real estate taxes and installments of special assessments which are due <br />and payable in the years preceding the year in which this Contract is dates are paid in full. <br /> <br />2 <br />
