<br /><6'-( 'd-- cr){ <br /> <br />EXCERPT FROM PLANNING COMMISSION MINUTES OF 8/12/98: <br /> <br />6e. Planning File 3057. Roger Krause is requesting a variance to increase the <br />coverage of the required rear yard from 25% to 37.5% for the purpose of <br />constructing a 26' x 26' (676 sf) garage at 1306 Ryan Avenue West. <br /> <br />Chair Harms opened the hearing and requested Dennis Welsch present a <br />summary, based on written reports of July 8, 1998, of the variance request for <br />construction of a garage at 1306 Ryan Avenue West. <br /> <br />Dennis Weslch defined the variances as a driveway setback variance of 2', <br />building size variance of 226 sJ., and a lot coverage variance of 12.6% and <br />reviewed the hardship involved. The staff recommended approval. <br /> <br />Larry Holms, representing the applicant, reviewed the request. <br /> <br />There being no further questions or comments, Chair Harms closed the hearing. <br /> <br />Motion: Member Mulder moved, Member Rhody seconded, to recommend <br />approval of Roger Krause's request for a variance to increase the lot coverage to <br />37.5% of the required rear for the purpose of constructing a 26' x 26' <br />replacement garage at 1306 Ryan Avenue West and a variance to reduce the <br />setbck of a driveway to three feet for the purpose of bringing an existing <br />driveway into compliance and allowing the extension of said driveway to access <br />the new garage, based on the following findings: <br /> <br />1) Section 1004.01 (A) of the City Code limits the size of an accessory <br />building to 25% of the required rear yard, which limits the size of a <br />detached garage on this property to 450 square feet. The proposed <br />garage will be 676 square feet in area (37.6% of the required rear yard). <br /> <br />2. The pre-existing, non conforming width of the parcel creates a physical <br />hardship for the applicant; it limits the size of an accessory building to 450 <br />square feet. (A standard, newly created lot would be 85 feet in width and <br />allow for approximately 635 square feet of accessory buildings.) The <br />substandard width of the parcel also creates a practical difficulty in <br />locating a driveway to access a detached garage. <br /> <br />3. The proposed variance is in harmony with the general purpose and intent <br />of the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br />The location of the house on the parcel and the interior design of the <br />house prohibits the construction of an attached garage of any size. The <br />proposed replacement garage will be setback the required five feet from <br />the western property line (existing garage is set back 3 feet). <br /> <br />4. The proposed variance, if granted, will not adversely affect the public health, <br />
