<br />" <br /> <br />Request For City Council Action <br /> <br /> <br />Manager Approved: <br /> <br />Date: 03.08.99 <br />Item No: <br /> <br />Agenda Section: <br /> <br />CONSENT <br /> <br />Item Description: Request for Lot Line Correction Minor Subdivision Approval: <br />Ron Dolle, 3096 Cleveland Ave., Roseville (PF30n) <br /> <br />1,0 Requested Action <br /> <br />1.1 Ron Dolle. 3096 Cleveland Avenue North, is requesting approval of a minor subdivision to <br />re-describe and correct a lot line over which a portion of his house was built. The request <br />was continued from the February 22, 1999 meeting to the March 8, 1999 meetng at <br />the applicant's request. <br /> <br />2.0 Background <br /> <br />2.1 This Ron Dolle request for approval of a Minor Subdivision was forwarded to the Council <br />for action on February 22,1999. The staff recommended approval. conditioned upon the <br />applicant compliance with a series of conditions. The Council continued this item to the <br />regular meeting of March 8, 1999. <br /> <br />2.2 Section 1l04.04D of the City Code dealing with minor subdivision corrections states: <br /> <br />Corrections; When a survey or description of a parcel or lot has been found to be <br />inadequate to describe the actual boundaries, approval of a corrective subdivision may be <br />requested. This type of subdivision creates no new lots or streets. The proposed corrective <br />subdivision. in sketch plan form, along with a letter signed by all affected owners agreeing <br />to the new subdivision, shall be submitted to the City Council for approval. No hearing or <br />Planning Commission review is necessary unless the proposal is referred to the <br />Commission by the Community Development Director for clarification. The proposed <br />parcels shall not cause any portion of the existing lots, parcels, or existing buildings to be <br />in violation of this regulation or the zoning code. A certificate of survey illustrating the <br />corrected boundaries shall be required on all parcels. Within thirty (30) days after approval <br />by the City Council, the applicant shall supply the final survey to the Community <br />Development Director and City Manager for review and approval. After completion of the <br />review and approval by the Community Development Director and City Manager, the <br />survey shall be recorded by the applicant with the Ramsey County Recorder within sixty <br />(60) days. Failure to record the subdivision within sixty (60) days shall nullify the approval <br />of the subdivision. <br /> <br />2.3 Ron Dolle, 3096 Cleveland Avenue North. completed a Certificate of Survey in August. <br />1998, and has found that his building addition extends over the south property line of his <br />property.
