Dear Mr. Olson: Thank you for your most recent letter regarding the return of your landscape guarantee. Although I do not recall indicating that I would return the letter of credit (LaC) you provided to guarantee the site landscaping, it is pennissible. Specifically, I will need to know who installed the landscaping and what type of guarantee the nursery/landscaper gave you on your plant material. Typically nursery's and garden centers have a minimum of a one-year guarantee on their plants and in some cases it may be as many as two years. This guarantee will prove helpful should any plants not survive the winter and need to be replaced in the spring, especially when the LOC has been returned prior to project closeout. The City has trust and confidence that you value your landscaping much like we do when we review and approve a landscape plan. With that said, the City will rely on you to replace (or to have replaced) all plants that that do not survive this winter. An inspection will still occur in Mayor June of2001 to close out the landscape portion of the project. Should dead plants be identified at that time, I will contact you and request your compliance. Attached is the LOC you provided the City for your site development project. Please return a letter to my attention indicating the nursery/garden center that professionally installed the landscaping and the guarantee they provided on the plants.
