We have a few comments regarding the content of the document <br />and would like to make you aware of these issues. We do not feel that it is appropriate for Lois to <br />sign the document in its current state. Following your review of our concerns, perhaps you could <br />contact us to discuss the issues. <br /> <br />The first paragraph describes the "DEVELOPER" as L.J.Olson Heritage, LLC (Cryogenic <br />Laboratories). Cryogenic Laboratories, Inc. is not the developer nor is there any business <br />relationship between L. J. Olson Heritage, LLC and CLI. It was our understanding that the <br />Agreement was between L. 1. Olson Heritage, LLC and the City ofRoseville. <br /> <br />Paragraph 9.4 Building Setbacks discusses the roadway easement of 16.6 feet when previously, <br />paragraph 8.7 Roadway Easement provides for an easement of 14 feet. We feel that this easement <br />should be consistent. <br /> <br />Paragraph 9.6 Landscaper Buffer Area, subparagraph A. states, ..........property line, which fence is <br />in addition to the existing fence and which ................. Our agreement with the neighbors is to <br />replace the existing fence along the rear property line of 1956 Lexington Avenue North and to <br />construct new fencing along the rear property line of 1088 Ryan. We and the neighbors understand <br />what we intend to do however, it might be prudent to include the proper plan in the Agreement. <br /> <br />Paragraph 9.17 Sign age is of great concern to us. We have had this discussion previously and <br />determined that we are not able to place our sign 15 feet from the west property line as it would be <br />in the parking lot. We need to either remove the statement orc.replace it with a corrected setback. <br />The last sentence of this paragraph is a surprise. I did not see it in any other prior documents we <br />have looked at. We must have the ability to distinguish between Cryogenic Laboratories, Inc.' s <br />entrance and the entrance to Lois's shop. According to this statement we would not be able to <br />identify our independent businesses by signage on the building or the canopy. This is not acceptable <br />and we\vould suggest that it be removed from the agreement. <br /> <br />Section 12. Notices refers to Lois J. Olson as the President of Cryogenic Laboratories, Inc.. Lois is <br />not the President of CLI and CLI should not be listed in this document. We suggest that this should <br />be corrected to read President, L. J.
