<br />3.0 STAFF COMMENT <br /> <br />3.1 In reviewing this request, staff made the following findings: <br /> <br />1. This drainage easement was included in the plat of CW Michael Third Addition <br />when it was platted in 1951. <br /> <br />2. Since storm sewer was installed in this area in 1966 and the culvert within the <br />easement was plugged, the drainage easement is no longer used or needed by the <br />City. <br /> <br />3. The proposed vacation of this drainage easement over Lot 5, Block 6, CW Michael <br />Third Addition, will not have an adverse impact on the general public health, safety <br />and welfare. <br /> <br />4.0 STAFF RECOMMENDA nON <br /> <br />4.1 Based on the findings outlined in Section 3.1, staff recommends approval of the request <br />for vacation of the 16 foot drainage easement along the southwest side of the parcel at <br />2441 St. Albans Street North (Lot 5, Block 6, CW Michael Third Addition). <br /> <br />5.0 SUGGESTED PLANNING COMMISSION ACTION <br /> <br />5.1 By motion, recommend approval of Thomas & Mary Sue VanBerkel's request for vacation <br />of the 16 foot drainage easement along the southwest side of the parcel at 2441 St. Albans <br />Street North (Lot 5, Block 6, CW Michael Third Addition), based on the findings outline <br />in Section 3.1. <br /> <br />5.2 The Planning Commission's recommendation will be forwarded to the City Council for <br />final action on November 23,1998. <br /> <br />Attachments: Property location map; notice of public hearing; portion of plat showing drainage easement; proposed <br />site plan; photograph of property. <br /> <br />60-day Time Limit: Application accepted on October 12, 1998; Decision deadline is December 11, 1998. <br /> <br />Prepared by: Kim L.
