2.2 Earlier this year, the applicant installed three above ground tanks on the property w:thout the proper permits. These tanks do not meet the size or separation requirements of the Fire Code and have been ordered removed by the City's Fire Marshal. The deadline for removing the tar:ks was October 12, 1998; however, a verbal extension was gran:ed to provide adequate time to process the applicant's request for above ground storage on this site and the variance from the requirements ofthe Fire Code. 2.3 ,Above ground tanks must be set back 3. mbimum of 50 feet frOr:1 a. property line ami a minimum of 50 feet from any building on '~11e property. If the amount of gasoline stored above ground exceeds 500 gallons in one tank andlor the amount of diesel stored above ground exceeds 1,000 gallons in one tank, tee dispensirrg unit(s) must be ~ocated a .minimum of 3C feet from the tanks. Based on the limited area on this site, the app~icant .could not install tee numbe::- and vo~ume of tanks req-aes::ec. and meet the set back requirements. Fo: this reas~n, the appEcant will need to req:rest a variance from the Fire Code. 2.4 Albrecht Companies has not yet submitted an application for plan review to the State Fire Marshal and or a notification form to the Minnesota Pollution Control Agency. 'Lhese items will be submitted if the installation of the tanks are approved by the City COuncil. 2.5 Section 902.06A of the City Code, which regulates the storage of flammable liquids, states that the storage of flammable liquids in outside aboveground tanks is prohibited in all areas other than bat area bounded by Cleveland Avenue, Highway 36, the northerr: City limits, and the western City limits. Section 902.06C of the City Code states, "notwithstanding the limits for abovegro-and storage tanks established in subsections A and B above, such storage tanks in other r:on- residentially zoned areas may be allowed by issuance of a permit approved by the City Council. Any screen walls shall be constructed of the similar and compatible materials to that of the principal structure. 3. The site and tank permit shall be :eviewed by the City's Fire Marsnal on an ann:lal basis, with ~ report being submitted to the City Council.
