January 25, 2000

Mr. Rick Cox
3116 F airview Avenue North
Roseville, Minnesota 55113

Re: Deadline for Interim Residential Unit within Office Building

Dear Mr. Cox:

You have requested a six-month extension of the deadline to remove a pre-existing non-
conforming residential unit from your office complex.

In March 1999 the City of Roseville approved a Planned Unit Development for your property
located at 3116 F airview Avenue.

A portion of the PUD specifically states: "... The existing residential rental property located on
the basement of the existing structure shall cease upon the execution of this agreement and the
rental property in the main level of the existing property shall be terminated within one (1) year
from the date ofthis executed agreement.. . ".

Initially that date for removal ofthe housing unit was scheduled for April 1,2000. Staff
understands that there may be some complications arising from the housing relocation in such a
short period of time. It is possible for the staff to provide some assistance in housing relocation
by extending the removal date by six months, to September 30, 2000. In order to accomplish this,
I will ask the City Building Inspector and Fire Marshall to re-inspect the housing unit for life
safety issues. Assuming the unit passes a life safety inspection, the unit may remain for an
interim period, not to exceed six months, but no later than September 30,2000.

On or before August 1,2000, please provide the City with a copy of your notice to the tenant to
vacate the unit by September 30,2000. After September 30th, the space used as a residential unit
must be converted to office space to comply with the terms of the PUD for this site.

Should you decide to attempt to extend the residential use within the office complex beyond
September 30th, you will have to request approval of a PUD zoning amendment.
Contact the City Planner Thomas Paschke (651-490-2236) to start this process on or before
August 1,2000.

The City appreciates the good faith effort to comply with the PUD agreement and to improve the
property, but also wishes to provide additional time for a comfortable residential relocation.

If there are questions, feel free to contact me or Thomas Paschke.

Sincerely,

Dennis P.
