<br />DRAFT <br /> <br />City Of Roseville <br />Planned Unit Development Agreement # <br /> <br />AGREEMENT, dated March 22, 1999, between the City of Roseville, a Minnesota municipal <br />corporation (herein referred to as "CITY"), and Cox Insurance Associates, Incorporated, a <br />Minnesota Corporation (herein referred to as "DEVELOPER"). <br /> <br />1.0 Effective Date of Agreement <br /> <br />This agreement shall be effective upon completion of the following: I) passage and publication of <br />Ordinance # _ (Rezoning of Property to PUD); 2) publication of the ordinance in the CITY's <br />official newspaper; 3) execution of this agreement by the CITY and the DEVELOPER; and 4) <br />recording of this agreement with Ramsey County. <br /> <br />2.0 Request for Planned Unit Development Approval <br /> <br />The DEVELOPER has asked the CITY to approve a Planned Unit Development (PUD) (PF#3092) <br />consisting of a 4,929 s.f office business on the parcel of property currently occupied by a barber <br />shop, travel agency and rental unit. The subject property is located at 3116 Fairview A venue, and <br />is legally described as follows: <br /> <br />(PID042923120001) <br /> <br />Commencing at the Northwest comer of the Northeast Quarter of Section4, <br />Township 29, Range 23; thence east 200.00 feet; thence south 133.00 feet; thence <br />west 200.00 feet; thence north 133.00 feet to the point of beginning. <br /> <br />3.0 Planned Unit Development Approval <br /> <br />The CITY hereby grants approval of the final development plan for Cox Insurance Associates, <br />Incorporated, subject to the DEVELOPER's compliance with the terms and conditions of this <br />agreement. The CITY agrees to approve applications for building permits, provided that said plans <br />are consistent with the exhibits which were approved at the concept and final stage of the Planned <br />Unit Development process (located in Appendix A), the DEVELOPER has not defaulted, and all of <br />the standards and condition.s of this agreement have been satisfied. <br /> <br />,For three (3) years from the date ofthis Agreement, no amendments to the CITY'S Comprehensive <br />Guide Plan or official controls shall apply to or affect the use, development density, site layout, or <br />dedication requirements of the land included within the Planned Unit Development unless required <br />by,state or federal law or agreed to in writing by the CITY and the DEVELOPER. For any <br />improvements proposed thereafter, notwithstanding anything in this Agreement to the contrary, the <br />CITY may require compliance with any amendments to the City's Comprehensive Guide Plan, ~ G\ <br />official controls, platting or dedication requirements enacted after the date of this Contract. \... ~ ' <br />7" 0 <br /> <br />1 <br />
