LARKIN, HOFFMAN, DALY & LINDGREN, LTD.

Mr. Steven R. Sarkozy
Thomas M. Scott, Esq.
May 28, 1999
Page 20

. Development Agreement Proposed by Bradley and Cub Foods

Bradley and Cub Foods concur in Resource Strategies Corporation's finding that a development
contract is an effective mechanism to enforce site plan approval standards and conditions to
development. This land use analysis, including the attached studies by various land use
professionals, contains numerous site and building design provisions and operational restrictions
to achieve compliance with applicable regulations, to minimize impacts, and to address
neighborhood concerns. Bradley and Cub Foods recognize that it is important to make a binding,
enforceable commitment to adhere to these conditions and restrictions on an ongoing basis.
Therefore, Bradley and Cub Foods proposed to work with neighbors and City staff to refine the
proposal, if necessary, and to enter into a binding development agreement with the City applicable
to the proposed Cub Foods project.

This land use analysis is the first step in this process. Bradley and Cub Foods intend to schedule a
neighborhood meeting for the second week of June to present the land use analysis to affected neighbors.

We ask that the City review this land use analysis as expeditiously as possible and get back to us with
some type of response within two weeks. Bradley and Cub Foods look forward to working cooperatively
with the City and neighbors so that the proposed Cub Foods store will be an asset to the community.

Sincerely,

~~~
Linda H.
