Many areas need addressing <br />before this vacation is approved by the City Council. Among concems are the potential code violations: <br />· Ordinance 275, 5-12-59: Rear yard of shopping center district includes the loading and selvicing area of <br />a building and where such a rear yard is adjacent or across the street from a residential district, the <br />building setback shall be one hundred twenty feet and the buffer stnp shall be sixty feet. <br />· Non-compliance with the noise ordinance (retail establishments should be held to the same standards <br />as homeowners) <br />.. Will Bradley ask for more concessions from the neighborhood? <br />· Access to Cub - do you open residential streets to accommodate Cub in a few years when they <br />approach you about their failing business due to poor access? <br /> <br />One city cow1cil member expressed the "tied hands" syndrome. We don't buy it. Require an independent <br />assessment and get information on similar situations in other communities. SuperValu (owner of corporate Cub <br />stores) did a feasibility study regarding the Hal' Mar location and found it an inapproptiate site. What makes it an <br />appropriate location for a franchise? <br /> <br />Our home was built 10 years b~fore Hal' Mar was even a sparkle in Matie Slawik's eyes. Since Clystal ball gazing is <br />not a skill of ours, we could not predict car alarms and 24 hour a day shopping. As you vote on March 22, we <br />urge you to keep Rainbow Foods on County Rd. B2 in mind, as a prime example of poor planning. We will not <br />graciously surrender our community to Bradley Management so they can make a buck and sell it in a year. <br /> <br />0\ <br />1.
