(PF3111) <br /> <br />1.0 Requested Action <br /> <br />1. Boaters Outlet, Inc., 2205 West County Road C2, has submitted an application for an Interim <br />Use Permit to allow an owner to buyer lot during the summer month, weekends only, on a <br />vacant parcel located adjacent 2205 West County Road C2. The site is zoned Light <br />Industrial (11). <br /> <br />2.0 Background <br /> <br />1. Section 1012.09A states: the City Council may authorize an interim use permit of <br />property. Interim use may not be consistent with the land uses designated on the adopted <br />Land Use Plan. They may also fail to meet all of the zoning standards established for the <br />district within which it is located. <br /> <br />2. Section 1012.09B states: the City Council may attach conditions to interim use permits. <br />In reviewing interim use permit applications, the City will establish a specific date or <br />event that will terminate the use on the property. The Council will also determine that the <br />approval of the interim use would not result in adverse effects on the public health, safety <br />and general welfare, and that it will not impose additional costs on the public if it is <br />necessary for the public to take the property in the future. <br /> <br />3. Due to its location directly underneath the NSP high voltage lines, the 1.92 acre parcel <br />has a limited use. <br /> <br />4. In 1997 an interim use permit was granted on the subject parcel to allow Burger Transfer <br />to store truck trailers. <br /> <br />5. In association with the interim use permit, the parcel was cleaned, properly filled, graded <br />for appearance, and fenced to meet City and Rice Creek Watershed specifications. <br /> <br />6. Each year the City Code staff corrects numerous vehicle complaints, many of which <br />relate to "for sale by owner" vehicles parked on grass or other non-conforming sites. In <br />1998, there were over 280 vehicle complaints. So far in 1999, there have been 88 similar <br />complaints.
