<br />13. A minimum of two (2) portable restrooms shall be located within the "owner to buyer lot" <br />and in a location convenient to patrons, such as just inside the main gate. <br /> <br />14. The small storage building adjacent the L.A. Auto Detail shop shall only be used for storage <br />not as a temporary office. <br /> <br />15. The existing illegal sign located on the L.A. Auto Detail building shall be removed, per <br />previous requests by the Community Development Department. <br /> <br />16. The illegal sign located on the fence adjacent County Road C2 and the gated entrance shall <br />be removed. <br /> <br />17. The Palmer Trucking building just north of County Road C2 is a nuisance and should be <br />painted per Section 407.02J of the City Code. <br /> <br />18. All debris shall be removed from the site. <br /> <br />19. The setback area along County Road C2 must be landscaped similar to the landscaping along <br />the south side of Berger Storage and Transfer's property (Boulevard trees in accordance with <br />the Street Tree Master Plan - trees from the East-West County Road group planted no less <br />than 35 feet on center.) as per Resolution 9454 dated August 25, 1997. The boulevard area <br />adjacent County Road C2 shall include sod as opposed to seed. <br /> <br />20. The initial term of the interim use permit shall be for a period of five years. Upon review and <br />hearing, the interim use permit may be issued for additional periods up to five years each. <br />The Council may discontinue this interim use after five (5) years for no cause, or at any <br />time during the five (5) year interim use term for violations of the City Code or this <br />permit. <br /> <br />21. The interim use permit shall be reviewed administratively on an annual basis on the <br />anniversary date of the resolution granting the interim use permit, with a staff report <br />submitted to the Planning Commission and City Council as needed. <br /> <br />22. The storm water management plan for the property and the use of calcium chloride as a dust <br />inhibitor must be reviewed and approved by the Rice Creek Watershed District prior to <br />occupation of the site. <br /> <br />23. The layout of the site shall be per the plan dated (accepted) April 7, 1999. <br /> <br />4.0 Staff Recommendation <br /> <br />Based on the findings and conditions listed in Section 3 of this report, staff recommends <br />approval ofthe interim use permit to allow a "owner to buyer lot" on the vacant 1.92 acre <br />parcel adjacent 2205 West County Road C2 with conditions listed in section 3,9 through 22 <br />above. <br /> <br />PF3111 - RPCA (041499) - Page 3 of 4 <br />
