WHEREAS. Developer has purchased property in the City of <br />White Bear Lake, zoned B-4, legally described as Lots 1. 2, 4 and <br />5, Block 1. White Bear Hi lIs Shopping Center, Ramsey County, <br /> <br />Minnesota ("property") for development as a shopping center. <br />WHEREAS, the City has initiat'ed' an amendment to its zoning <br />code which" amendment when finally adopted will restrict time.s of <br />deliveries,' locations of buildings ,and lqading docks and other <br />matters relating to shopping center developments in B-4 zones as. <br />well as providing for screening/buffer zones between shopping <br /> <br />centers and residential properties. <br /> <br />A copy of said ordinance <br /> <br />amendment is attached hereto as Exhibit A and is incorporated <br /> <br />herein by reference. <br /> <br />WHEREAS, City Staff and. the City Council indicated a <br />preference for prohibiting all deliveries pursuant to said <br />ordinance during the hours between'10:00 p.m. and 6:00 a.m., <br /> <br />however, at the instance of Developer. restrictions on deliveries <br />between those hours were not IQade applicable to single unit, <br />two-axled vehicles not in excess of 26,000 pounds gross vehicle <br />weight. <br />WHEREAS, Developer desires to be issued appropriate permits <br />from the city and to commence construction of the shoppi~g center <br />development on the property befor~" t,!!~ effectiy~ 9ate.--Qf~e..- <br />ordinance amendment described above. <br /> <br /> <br />F:l(# Cp 1'2-"331- 0' <br />
