(PF3177) <br /> <br />1.0 Background <br /> <br />1.1 At the Monday, December 13, 1999 City Council meeting the Council received <br />additional written and oral comments on proposed amendments to the City Code <br />relating to nighttime business uses and activities in Shopping Center Districts. <br />Following the staff and consultant reports and receipt of resident and business <br />testimony, the Council discussed the proposed amendments. Subsequently, the <br />Council voted to table further deliberation and possible action on the proposed <br />ordinance until Wednesday, December 15,1999. <br /> <br />1.2 In order to facilitate discussion and a decision regarding this proposal, staff has <br />attached a "clean" copy of the ordinance as recommended by the Planning <br />Commission, which was included in the Monday meeting agenda packet as <br />Attachment C, and is recommending that the Council consider additions and <br />deletions to the draft addressing the concerns raised at the Monday meeting. <br />These suggested revisions are shown by strike and underline type fonts, and <br />include additional punctuation and grammatical modifications as well as <br />substantive provisions. <br /> <br />2.0 Proposed Ordinance-Areas of ConcernlRemaining Issues <br /> <br />2.1 Review process. The ordinance proposes two processes for approval. The first <br />process would allow the Development Review Committee and the Community <br />Development Director to administratively approve "24 hour service" site plans <br />that meet existing and proposed City Code requirements. The staff would also <br />review minor amendments, defined as up to a 10% change in the building cube, <br />which as indicated in the record is consistent with the City's previous practices. <br />The second process would require a conditional use permit for any new structure <br />or expansion of an existing structure by more than 10% of its current gross floor <br />area. The conditional use permit process also addresses major issues that could <br />potentially impact residential areas directly adjacent to the Shopping Center <br />Districts.
