REQUEST FOR COUNCIL ACTION Date: 9/22/14 Item No.: 11.a Department Approval City Manager Approval Item Description: Consider a Vacation of a Portion of a Drainage and Utility Easement Located at 197 County Road B2 B ACKGROUND 1 In 1981 several drainage and utility easements were granted to the City of Roseville as part of 2 the filing of the TRANSIT 2ND ADDITION plat. The bulk of the drainage and utility 3 easements were established over an existing wetland and also, it appears, to provide for overland 4 drainage from County Road B2 to the wetland. 5 Recently the property owner at 197 County Road B2, which is Lot 2, Block 2, of the 6 aforementioned plat, has approached the City with the desire to develop the property. However, 7 in order to maintain the required wetland setback and still provide enough of a footprint for the 8 proposed use, the property owner has asked that the City reduce the width of the existing 9 drainage and utility easement along the west side of Lot 2, Block 2. The existing width of the 10 easement is 25 feet. 11 Staff has worked with the property owner to establish a storm water conveyance system 12 consisting of underground pipe to convey water to the rear of the lot that was traveling overland. 13 This pipe would be constructed by, and at the cost of, the property owner. If a pipe is used, then 14 the drainage and utility easement necessary to support that pipe would only be 10 feet. 15 Attached is a Surveyors Certificate depicting the proposed vacation of a portion of the drainage 16 and utility easement. 17 The vacation will be not be official until such time the City Manager executes and records a 18 Notice of Completion of this vacation. This will be done once a final design of the storm water 19 conveyance system has been approved by the City Engineer and any required agreements for the 20 construction of said system have been entered into. 21 Therefore, staff is recommending the vacation of 15 feet of the existing 25 foot drainage and 22 utility easement. 23 FI INANCIALMPACTS 24 There is no financial impact to the City of Roseville. The property owner will install the pipe, 25 catch basins, inlet and outlet structures, and any other devices necessary to convey the water to 26 the rear of the property to the satisfaction of the City Engineer. 27 SR TAFF ECOMMENDATION 28 Staff recommends that the City Council approve the attached resolution approving the vacation 29 of a portion of a drainage and utility easement located at 197 County Road B2. 30 Page 1 of 2
