<br />The Planning Commission and City Council have reiterated the City policy of <br />not approving variances for issues where physical hardship can not be <br />demonstrated. The Council has reiterated concern where proposals for flag lots <br />are introduced into neighborhoods with more conventional lot sizes and <br />setbacks. <br /> <br />4.0 STAFF RECOMMENDATION <br /> <br />Based on the findings outlined in Section 3 staff recommends denial (approval) of the <br />request for a variance from Section 1004.02(D) of the City Code to reduce the width of <br />two single family residential lots from 85 feet to 66 feet for the purpose of splitting a <br />35,420 square foot parcel with 132.56 feet of frontage into two parcel at 1992 Cleveland <br />Avenue and a variance to reduce the lot square foot from 11,000 to 8,910 square feet. <br /> <br />5.0 PLANNING COMMISSION ACTION <br /> <br />On May 12,1999 the Roseville Planning Commission held a public hearing regarding <br />the variance request by Seth Eggessa. At this hearing, an adjacent property owner <br />addressed the Commission regarding concern related to property value being <br />decreased should the variance and subsequent lot split, receive approval. The Planning <br />Commission identified their concern in allowing such a land division, especially given <br />the past history on a number of similar requests that were denied by the City Council. <br />Member Cunningham expressed his support for the request, given the modifications <br />discussed by staff; that he would not consider this division a flag lot; and his does not <br />oppose this division and its alternative lot configuration to allowing additional single <br />family housing on a large lot. The City of Roseville Planning Commission <br />recommended (6-1) to deny the request by Seth Eggessa for a lot width and lot area <br />variance, based on the findings in Section 3 of the Request for Planning Commission <br />Action dated 5/12/99. <br /> <br />6.0 SUGGESTED COUNCIL ACTION <br /> <br />By motion deny Seth Eggessa's request for a lot width and lot area variance, for property <br />located at 1992 Cleveland Avenue, based on the findings in Section 3 ofthis report. <br /> <br />Attachments: Property location map; proposed lot split. <br />Application accepted on April 29, 1999; Decision deadline is June 29,1998; 60 extension granted June 29,1999 to <br />deadline of August 23, 1999. <br />Prepared by: Thomas Paschke (490-2236) <br /> <br />Q:\Planning Files\311B_ Eggessa.
