<br />ARTICLE VI <br />EASEMENTS <br /> <br />Section 1. General. In addition to the easements, covenants, restrictions and <br />conditions of Article VIll concerning exterior controls, all Lots shall be subject to easements <br />and covenants hereinafter specifically described for the benefit of the specified adjoining Lots, <br />all as more fully set forth hereinafter in this Article. The easements set forth in this Article <br />shall supplement and not limit any easements described elsewhere in this Declaration or <br />recorded, and shall include reasonable access to the easement areas through the Lots in the <br />Common Elements for purpose of main~nance, repair, replacement and reconstruction. <br /> <br />Section 2. Owners' Rie:ht to Support. Each Owner shall have the right to <br />lateral support for his or her Lot and such right shall be appurtenant to and pass with the title <br />to each Lot. <br /> <br />Section 3. Delee:ation of Use. Any Owner may delegate, in accordance with <br />the By-Lays and Association Rules and Regulation his or her right of enjoyment of the <br />Common Elements and facilities to the members of his or her family, his or her tenants, or <br />contract purchasers who reside on the Lot. <br /> <br />Section 4. Utilities. The property shall be subject to a non-exclusive, <br />appurtenant easement for all utilities, water and sewer, and similar services, which exist from <br />time to time, as constructed or referred to in the Plat, or as otherwise described in this <br />Declaration or any other duly recorded instrument. Each Lot and the rights of the Owners and <br />Occupants thereof, shall be subject to a non-exclusive easement in favor of the other Lots for <br />all such services, including without limitation any sewer or water lines servicing other Lots. <br />Each Lot shall also be subject to an exclusive easement in favor of the Association and all <br />utility companies providing services to the Lots for the installation and maintenance of utility <br />metering devices. <br /> <br />Section 5. Easement for Overhane:s and Porches. As part of the original <br />construction of a living unit the Declarant intends to construct porches, fireplaces and other <br />overhangs which may encroach upon the Common Elements. The Owners of any Lot to <br />which is attached a porch, fireplace or other overhang which encroaches on the Common <br />Elements shall be granted an exclusive easement over and across the Common Elements to <br />maintain the encroachment. An easement shall also be granted for any encroachment resulting <br />from any reconstruction, alterations allowed pursuant to Article VIII hereof, repair, settlement <br />or movement. Use of any porch, fireplace or other overhang which encroaches shall be <br />limited solely to the Owner and Occupant of the Lot to which it is attached. <br /> <br />Section 6. Owners Easements of Enjovment. Every Owner shall have the <br />right and easement in an to the Common Elements which shall be appurtenant to and shall <br />pass with the title to every Lot subject to the following conditions: <br /> <br />(a). The right of the Association to suspend the voting rights of an <br />Owner for any period during which assessments against his or her <br />Lot remain unpaid; and for a period not to exceed sixty (60) days <br />for any infraction of its published Rules and Regulations; <br /> <br />(b). The right of the Association to dedicate or transfer all or any part <br />of the Common Elements to any public agency, authority, utility <br />for such purposes and subject to such conditions as may be <br /> <br />9 <br />
