TRANSFER OF TITLE: Upon perfonnance of this Purchase Agreement by Buyer, Seller <br />shall execute and deliver a Warranty Deed, conveying marketable title to the Property subject only <br />to the following exceptions: (1) Building and zoning laws, ordinances, State and Federal <br />regulations. (2) Restrictions relating to use or improvement of the Property without effective <br />forfeiture provision. (3) Reservation of any minerals or mineral rights by the State of Minnesota. <br />(4) Utility and drainage easements which do not interfere with proposed improvements. f\.. '( <br /> <br />2. Seller <br />makes no representations concerning the amount of real estate taxes for subsequent years. <br /> <br />4. POSSESSION: Seller shall deliver possession on the Closing Date. <br /> <br />5. ENVIRONMENTAL CONCERNS: To the best knowledge of Seller, at the present time no <br />environmental matters exist on the Property. Seller has previously owned and developed the <br />property platted as Owasso Hills which lies directly to the north of the Property. Certain <br />activities occurred on the Owasso Hills property prior to its development which are described on <br />attached Exhibit A. Seller does not know whether any of such activities occurred on the <br />Property.
