<br />ROADWAY&UTILITY EASEMENT <br />02-31-46 <br /> <br />THIS INDENTURE, made this _ day of September, 1999 by and between Bror Corporation (a <br />Minnesota Corporation) of the County of Ramsey, of the State Minnesota, parties of the first part, <br />and the CITY OF ROSEVILLE, Ramsey County, Minnesota, a municipal corporation, party of <br />the second part. <br /> <br />WITNESSETH: That in consideration of the sum of$ 1.00 and other valuable considerations in <br />- - <br />hand paid by the said party of the second part, said parties of the first part do hereby grant and <br />convey unto party of the second part, its successors and assigns, a perpetual easement for a public <br />road and highway and for underground utility mains, pipes and appurtenances under and across the <br />following described property in Ramsey County, Minnesota: <br /> <br />THE EAST 20.0 FEET OF THE WEST 30.0 FEET OF THE FOLLOWING DESCRIBED <br />PROPERTY AND A 10.0 FOOT WIDE UTILITY EASEMENT THE CENTER LINE IS <br />DESCRIBED AS FOLLOWS: Commencing at a point on the North line of the following <br />described property; said point being 120.02 feet East of the West line of said following <br />described property; thence Southerly and parallel with the West line of said property a <br />distance of 95.01 feet; thence West and parallel with the North line of said property a <br />distance of 120.02 feet and there terminating, said easement is over and across the West <br />300.0 feet ofthe North 180.0 feet ofthe South 480.0 feet ( Subject to road over the west 10 <br />feet) of Government Lot 3 in Section 2, Township 29, Range 23, Ramsey County, Minnesota. <br /> <br />which easement shall include the perpetual rights of said City of Rose vi lie, its successors or assigns, <br />to grade, level, fill, drain, pave, build, maintain, and rebuild or widen a public road or highway, <br />together with such culverts, cuts, or ditches as may be necessary, and to construct, maintain, <br />operate and repair underground utility mains, pipes and appurtenances over and across a strip of <br />land hereinbefore described, together with perpetual easement for ingress and egress, all without <br />additional compensation. <br /> <br />TO HAVE AND TO HOLD THE SAME, together with all the hereditaments and appurtenances <br />thereunto belonging, or in anywise appertaining, to the said party of the second part, its successors <br />and assigns, forever. <br /> <br />IN TESTIMONY WHEREOF, the said parties ofthe first part have hereunto set their hands the <br />day and year first above written. <br />
