<br />October 11, 1999 <br /> <br />City Planner and <br />Planning Commission Members <br />2660 Civic Center Drive <br />Roseville, MN 55113 <br /> <br />Re: Planning File #3140 (C.Kadrie) <br /> <br />Dear Planning Commission: <br /> <br />I am aware that at your meeting on October 13, 1999 you will be discussing the request <br />of Charles Kadrie regarding a variance for his property at 1281 Josephine Road. <br /> <br />I have lived on Lake Josephine basically all of my life and I know from first hand and <br />many past experiences, when one wants to make improvements to his/her property and <br />there is a question as to setback requirements, a permit is required. Over the years there <br />have been several instances on the lake where construction was started or completed and <br />a permit was not issued, only to lead to serious consequences for the property owner, <br />neighbors and the City ofRoseville. <br /> <br />When the deck construction was started at 1281 Josephine Road, I thought it was strange <br />that we as neighbors, had never been asked to sign a petition for a variance. The <br />construction was proceeding outward toward the lake and I wondered how this could be <br />done. I asked the question ofthe Building Inspection Department at Roseville and it <br />seemed that flags started to go up. Mr. Kadrie appeared at our door and asked, "why we <br />hadn't come to him for an explanation?" As both my husband and myself explained to <br />him at that time, we didn't have a problem with what he was doing - if what he was <br />doing was legal. From the beginning that has been our only question and concern. <br /> <br />Several weeks ago, at about fifteen minutes before the City Council meeting at which his <br />request was to be addressed, Mr. Kadrie knocked on our door and asked if! would sign a <br />petition that he would present to the council that evening. He told me that this petition <br />asked of the neighbors if they thought that the improvements to his property were <br />pleasing to the neighbors/neighborhood. I again asked him if, ''what he was doing was <br />legal?" He could not answer my question and I couldn't sign his petition. I noticed at <br />the time that he had many signatures of neighbors that are outside of the 350"ofhis <br />proposal. <br /> <br />I am fully aware that fill and rocks have been added to the shoreline in order to protect a <br />walnut tree, but my question remains the same to him and to you, "is what is being done <br />regarding the deck construction, legal?" <br />
