An examination of the information submitted with the variance application indicates that <br />the proposed deck can easily be redesigned so that it will not approach any closer to the ordinary <br />high water (OHW) elevation than the existing kitchen. In addition, there does not appear to be any <br />hardship that justifies granting Mr. Kadries variance request. Therefore, the DNR would object to <br />the approval of this variance request. A more detailed examination of the issues concerning this <br />variance application are as follows: <br /> <br />1. While the information submitted with the variance is unclear, previous inspections of Mr. <br />Kadries Property have shown that the Kadrie residence is located well within the 751 setback <br />required by the Roseville Shoreland Ordinance. The completion of the proposed deck <br />would increase the substandard dimension of this non-conforming structure, which is <br />discouraged by the Roseville Shoreland Ordinance. <br /> <br />2. The approval of the Kadrie Variance would set a precedence for the approval of other <br />shoreland variances without due justification. The City should carefully consider the issues <br />in light of future requests by property owners. <br /> <br />3. The plans that were sent with the variance request indicate that there is ample room for <br />decks to be constructed on the west and east sides of the house. These decks could be <br />constructed without approaching any closer to the OHW than the existing structure. I <br />Therefore, a deck between the house and the OHW is unacceptable. <br /> <br /> <br />4.
