The owner or other person referred to in Subd. 1 above shall cause the <br />contents of containers to be collected by a collector licensed under Section 436 once every week, <br />more frequently if necessary, or as required by the City. However, collection shall not be required <br />if the said owner or other person ensures to the satisfaction of the City that a sanitary and <br />environmentally sound alternative is used to dispose of the contents of containers. (Amended, Ord. <br />Nos. 83-29, Sec. 10; 89-19, Sec. 5; 93-13, Sec. 4) <br /> <br />Subd. 4. Placing of Containers. Refuse containers shall be placed in the rear of the premises or in <br />such a manner as to be out of view from the street in front of the premises or placed in a garage <br />located on the premises; except as may be reasonable and immediately necessary for collection. In <br />no event shall containers be placed or maintained in such a way as to unreasonably interfere with <br />the use of adjoining property. <br />(a) Containers kept outside shall be placed in such a manner as not to permit entry <br />of or harborage for animals, insects or other vermin and so maintained as not to be <br />tipped over. <br /> <br />(b) Containers shall be maintained in a reasonably clean condition at all times. <br /> <br />(c) Refuse and refuse containers shall not be moved or placed for collection sooner <br />than the day prior to scheduled collection, nor shall the same be permitted to <br />remain there or in a manner contrary to the placement requirements set forth in this <br />Subd. 4 for more than twenty-four (24) hours. (Added, Ord. No. 87-45, Sec. 1) <br /> <br />Subd. 5. Defective Containers. Whenever a container is in poor repair, is corroded or otherwise <br />defective so as to permit insects, vermin or rodents to enter, or does not meet any other <br />requirements of Section 1005, the collector shall notify the owner or occupant in writing on forms <br />furnished by the City for such purpose. A copy of said notice shall be furnished to the City <br />Administrator's office. <br />(a) The collector shall affix the owner or occupant's notice to the container. The <br />notice shall state the deficiency and shall require repair or replacement on or before <br />the next collection date. If the deficiency is not corrected by said compliance date, <br />the City shall condemn the deficient container and affix a tag so stating such <br />condemnation. (Amended, Ord. No. 89-19, Sec. 6) <br /> <br />(b) It is unlawful for any person to place or deposit refuse in a container which has <br />been condemned. <br /> <br />Section 1005:10. (Repealed Ord. No. 89-19, Sec. 7 - see Section 436) <br /> <br />Section 1005:15. Refuse Littering Prohibited. Except as otherwise provided by ordinance, it is unlawful <br />to throw, scatter or deposit, or cause or permit to be thrown, scattered or deposited, any refuse, handbill, <br />or other material (such as recyclables as defined in Sections 1007:00, Subd. 17 and 435:00, Subd. 3, or <br />yard waste) upon or in any public or private place, land, body of water, vehicle or structure within the <br />municipality. Every person shall maintain his premises and abutting sidewalks and boulevard areas free <br />of refuse litter. (Amended, Ord. No. 89-19, Sec. 8) <br /> <br />Section 1005:20. Nuisance Abatement. On any premises any accumulation of refuse not stored in <br />containers which comply with this Section, or any accumulation of refuse which has remained thereon <br />for more than one (1) week is hereby declared to be a nuisance and may be abated by order of the City <br />and the cost of abatement, together with a certification processing fee in the amount set forth in Section <br />515, may be assessed on the property where the nuisance was found as provided by Minnesota Statutes, <br />Section 145.23. This remedy shall be available both in addition to and as an alternative to the criminal <br />penalties provided in Sections 1100:00, Subd. 1 and 1100:20, for violations of any provision of the <br />Ordinance Code.
