Appeal Against the Setback Permit for 2940 Old Highway 8
without such a plan. This condition should not be taken as counting toward the
required minimum.

10.1. The roof of the new garage appears from the plans to be taller than the
roof of the house. This condition should perhaps not be taken as counting
toward the required minimum .

12.b The names of the owners of2948 Old Highway (us) are incorrectly listed
as "Keith Kerr".

12.c The is no grading or drainage plan with the copy of the application
supplied to us. There is also no landscape plan.

12.d "We feel that we are not going to negatively impact our neighbor's or the
city limits with this addition." We were not given the details of this application.
Todd Kaus has told one ofus (Keith Hauer-Lowe) that they intended to build a
garage and that the cost of "span crete" was prohibitive, but at no time were we
asked if any such development might impact us or told that any reduction in
the standard setback might be required. While they are not required to provide
us with such information or even ask our opinion except through the permit
process, we feel that they are aware of our concerns about encroachments near
our property and intrusions onto our property and that they may also be aware
of our liking of the current openness of the properties.

September 12, 1999
