<br />MINUTES FROM THE OCTOBER 7 DEVELOPMENT REVIEW <br />COMMITTEE'S SETBACK PERMIT HEARING <br />DATE: OCTOBER 8, 1999 <br /> <br />The meeting began at 3 :40 p.m. with members Debra Bloom, Cathy Bennett, Doug <br />Strong and Thomas Paschke in attendance. Also present were Keith Hauer-Lowe & <br />Loralee Kerr, property owners at 2948 Old Highway 8. Absent were Todd & Kim Kaus, <br />2940 Old Highway 8, Setback Permit applicants. <br /> <br />The meeting began by allowing Mr. Hauer-Lowe and Ms. Kerr an opportunity to review <br />their concerns with the proposed encroachment and the 12 criteria stated in the Setback <br />Permit application. <br /> <br />Mr. Hauer-Lowe and Ms. Kerr reviewed each of the 12 criteria listed and explained their <br />position on whether they should be counted toward the required 8 necessary for approval <br />by the Development Review Committee (DRC). They also made suggestions, as did the <br />DRC, for minimizing potential impacts. <br /> <br />Mr. Hauer-Lowe also indicated some displeasure with the language of certain criteria <br />listed in the application, indicating that how the DRC views/interprets the criteria should <br />be noted in the application. <br /> <br />The DRC stated that they would gladly review suggestions for their first year review of <br />the process and incorporate any applicable modifications. <br /> <br />The DRC, Mr. Hauer-Lowe and Ms. Kerr agreed that additional conditions should be <br />placed on the development proposal to minimize intrusion and future parking. <br /> <br />The DRC unanimously recommended approval of the request for a Setback Permit by <br />Todd and Kim Kaus to allow an encroachment into the required 10 foot side yard setback <br />six (6) feet, one (1) inch for the purpose of constructing additional living space and an <br />attached double stall garage, subject to the following conditions: <br /> <br />a. Submission of a survey that indicates that placement of the proposed <br />addition and the grading of the site after construction is complete. <br /> <br />b. Installation of gutters to direct storm water run-off away from adjacent <br />properties. <br /> <br />c. Installation of a fence 16 feet in length and placed adjacent to the area of <br />encroachment. The fence style shall be of a variety that is more of a <br />boundary marker than for privacy and which final style is negotiated <br />between the Kaus's and Mr. Hauer-Lowe and Ms. Kerr. <br />
