<br />3.5 The property has two retaining walls to accommodate the unique elevation change on <br />the lot. The first is located along Alta Vista and was constructed as a component of the <br />roadway reconstruction. The second retaining wall is located in the side yard adjacent <br />to the home and Dale Street. <br /> <br />3.6 A small rear/side yard (north & east) exists on the north side of the lot and home. <br />Because this is the only flat area on the lot the three children use the location for a play <br />area. <br /> <br />3.7 The proposed porch addition, though encroaching to a point 8.6 feet from the Alta <br />Vista Drive property line, would provide an architectural design and living area that <br />would not be afforded to the homeowners unless placed on the north side of the home <br />and within the play area. <br /> <br />3.8 Staff has determined that the limited flat area on the lot, the unique shape of the lot, <br />the lot's double frontage, and the date the home was constructed, are all pre-existing <br />hardships for this property that afford no alternative other than a variance. <br /> <br />3.9 The variance, if granted, will not adversely affect the public health, safety, or general <br />welfare of the citizens of Roseville. <br /> <br />4.0 STAFF RECOMMENDATION <br /> <br />4.1 Based on the finding outlined in Section 3, staff recommends approval of the request <br />for a variance from Section 1004.02D of the City Code to reduce the front yard setback <br />from 30 feet to 8.6 feet to accommodate the construction of a porch on property <br />located at 1810 Alta Vista Drive. <br /> <br />5.0 PLANNING COMMISSION ACTION <br /> <br />5.1 By motion approve (deny) the request by Nadya EI-Afandi's request for a variance from <br />Section 1004.02D of the City Code to reduce the front yard setback from 30 feet to 8.6 <br />feet to accommodate the construction of a porch on property located at 1810 Alta <br />Vista Drive. <br /> <br />Q:\Planning Files\3152_Kinnunen_EI-Afandi\RPCA (101399),doc <br /> <br />Planning File #3152 (Nadya El_Afandi) 10.13.99 Page 300 <br />
