Related platting approvals were granted shortly thereafter. <br /> <br />B. Normandale Lake Office Park EA W. <br /> <br />~ <br /> <br />In February 1982, Trammell Crow prepared and submitted to the City an environmental assessment <br />, worksheet for Normandale Lake Office Park ("Nonnandale Lake EA W"). At that time, Normandale Lake <br />Office Park consisted of903,000 square feet of office space, a 12-story, 275 to 300-room hotel on the <br />Phase IV Site, and up to 186 multi-family residential units. At that time, an EA W was required because <br />the project involved construction of a facility or integral use of facilities with at least 250,000 square feet <br />of commercial or retail floor space, 'Or at least 175,000 square feet of industrial space, or a mixture of <br />commercial, industrial and retail floor space totaling at least 250,000 square feet unless located in an <br />industrial park for which an envirorunental impact statement has already been prepared. In 1982, the <br />Minnesota Environmental Quality Board C'"EQB") Environmental Review Program Rules CEQB Rules") <br />did not include mandatory environmental impact statement thresholds. <br /> <br />After a 30-day comment period, on March 19, 1982, the EQB advised the City rhnt no objections to the <br />Nonnandale Lake EA W's negative declaration that an environmental impact statement was not needed for <br />the project were received by the EQB. The City was further authorized to take final action to approve or <br />commenc~ the project. . <br /> <br />C. Normandale Lake Office Park Indirect Source Permit. <br /> <br />In September 1982. Trammell Crow applied to the Minnesota Pollution Control Agency ("MPCA") for an <br />indirect source pennit ('"ISP") for Normandale Lake Office Park. Under MPCA rules, an ISP was needed <br />because NonnandaIe Lake Office Park was a new indirect source with an associated parking area which <br />had a new parking capacity of2,000 cars or more. Minn. Rules, Pt. 7001.1270, subp. 2(A). <br /> <br />In July 1983, MPCA issued ISP 83-5 to construct Normandale Lake Office Park. ISP 83-5 authorized the <br />following land uses: 8300 Tower - 300,300 square feet and 975 parking spaces; 8400 Tower - 323,300 <br />square feet and 975 parking spaces; 8500 Tower - 288,000 square feet and 900 parking spaces; Phase IV <br />Site - 300-room hotel and 400 parking spaces; and 186 multi-family units and 410 parking spaces. <br />ISP 83-5 did not require construction of any new roadway improvements. As described in Section 1.8- <br />above, in the mid- to late 19805, Trammell Crow received City Council approval to increase the density of <br />the originally proposed Phase II and Phase ITI office buildings, now referred to as the 8400 Tower and the <br />8500 Tower, respectively. In October 1990, a formal request to modify ISP 83-5 to transfer and apportion <br />Trammell Crow's rights and obligations under the permit to and among the new owners and, further, to <br />modify the type and intensity of land uses specifically enumerated in the permit to conform to the type <br />and intensity of land uses actually approved by the City was submitted to :MPCA. The October 1990 <br />request to modify ISP 83-5 was supported by a September 1990 updated traffic and air quality analysis <br />prepared by BRW. <br /> <br />On March 25, 1992, MPCA issued ISP 92-5, a modification ofISP 83-5 to construct Normandale Lake <br />Office Park, to Minnesota ND Properties, Frederick Wall, Jostens, and the City.
