The Developer has indicated that primary residency <br />will be restricted to persons 62 years of age and older; ti - ~~ <br />~Wt$i6w RlHiIt :ee_~i~ hMiHni~~"~"~;RWketed t<;> <br />seniors andlor potential residents with ambulatory and_memory disabilities. <br />Any future changes to the restrictive covenants, i-=~4IR3"e"t 1l9t L~~~d hi <br />,tY&g'~!,~.hc;,., must be submitted to the City for review and approval; <br />however, the City is not be a party to the restrictive covenants. <br /> <br /> <br />9.4 Building Setbacks. Building setbacks (as approved) must be as shown on the <br />approved site development plan (Exhibit A). <br /> <br />9.5 Off-street Parking. Based on the proposed use of the building for assisted <br />living/seniors, City Code provisions requiring the 158 off-street residential <br />parking spaces for visitors and employees parking may not be needed. The <br />Developer may reduce the amount of off-street parking to 39 spaces, with <br />proof-of-parking documentation being provided for an additional 39 spaces <br />(Exhibit K). If the City, in its sole discretion, determines that the additional <br />39 spaces are needed, the Developer (including heirs, successors or assigns) <br />must provide such spaces in accordance with applicable provisions of the City <br />Code within 180 days of written notification by the City. Development ofthe <br />parking area adjacent to Fry Street or Oakcrest Avenue and any additional <br />expansion of on-site parking must have 80% opaque year-round screening and <br />berming to a minimum height of 30" above curb height or otherwise be <br />reviewed and approved by the City. Ifvegetation is used as screening, it must <br />be coniferous hedge or tree material. <br /> <br />9.6 Building Height. See ion _ 0 e City Code. <br /> <br />9. 7 Building Materials and Design. Building materials shall be brick, low <br />maintenance vinyl and wood as shown on the approved building elevations <br />(Exhibit G). Building design shall include architectural turrets, a covered <br />entry and porch, a pitched roof and design elements as shown on the approved <br />building elevations. The color scheme and materials pallet for the building <br />shall be reviewed and approved by the Community Development Director <br />prior to issuance of any building pennits for the project. Accessory buildings <br />shall not be allowed. Trash dumpsters shall be completely screened and <br />roofed, or placed within the structure. <br /> <br /> <br />9.8 Site Lighting. Lighting for the building exterior and off-street parking area <br />shall be consistent with the attached lighting plan (Exhibit F) and the <br />requirements of Section 1010.12 of the City Code.
