EASEMENT NO. 1 THIS INDENTURE, Made this JI./-!;t day of J4 u;oJ~i ,1978, by and between NAZARETH BUILDING ASSOCIATION, INC., NORTH AMERICAN LIFE ASSURANCE COMPANY and AMERICAN NATIONAL BANK AND TRUST COMPANY, Qf the County of Ramsey, State of Minnesota, parties of the first part, and the CITY OF ROSEVILLE, Ramsey County, Minnesota, a municipal corporation, party of the second part, WITNESSETH: That in consideration of the sum of $1.00 in hand paid by the party of the second part, the receipt where- of is hereby acknowledged by the parties of the first part, said parties of the first part do hereby give and grant unto party of the second part, its successors and assigns, a perpetual easement for underground utility mains, pipes and appurtenances under and across . the foll~wing described property in Ramsey County, Minnesota: The south 10.00, feet of the north 25.00 feet of the east 65.~0 feet of the west 320.00 feet and the north 15."0.0 feet of the east 10.00 feet of the west 265.00' feet of the following tract north 150 feet of south 335 feet of east 655.50 feet of the northeast 1/4 (NE1/4) of northeast 1/4 (NE1/4) (subj. to hwy. and rds.) in Section 9, Town 29, Range 23. EXEMPT FROM STATE DEED TAX which easement shall include perpetual right of said City of Rose- ville, its successors and assigns, to construct, maintain, operate and repair underground utility mains, pipes and appurtenances over and across' a strip of land hereinbefore described, together with perpetual easement for ingress and egress, all without additional compensation.
