<br />REQUEST FOR PLANNING COMMISSION ACTION <br /> <br />Item Description: <br /> <br />DATE: 04/11/01 <br />ITEM NO: 7e <br /> <br />Agenda Section: <br />Actions <br /> <br />Report on Sunrise Senior Housing -Easement Vacation <br />(PF3159) <br /> <br />Manager Approved: <br /> <br />Department Approval: <br /> <br />1.0 BACKGROUND <br /> <br />The Planning Commission previously recommended and the Council approved a Planned Unit <br />Development for the 79 unit Sunrise Senior Housing Project at 2555 Snelling Avenue. This project is <br />well under way, but it did require a torrents title process in order to provide clear title. As part of the <br />historical search of the site, an old utility easement was found on the site that is no longer needed. This is <br />a matter of correcting the paper records. <br /> <br />Mike Cancilla the Sunrise representative, has asked the City to vacate this easement in order to facilitate <br />the final financing ofthe project. Timing is important in this case. (The Commission nonnally holds the <br />hearings on these vacations. In this case, because the easement was just recently found, the applicant has <br />requested that an expedited schedule be used which would allow the Council, after a hearing, to make a <br />decision in late April or early May. The nonnal process would require at least 1 additional month <br />because of the notice requirements for the Planning Commission meeting.) <br /> <br />The staff recommends that this easement is no longer needed or used and should be vacated, allowing <br />Sunrise to complete the construction and financing on the site. Direction is sought from the Commission <br />in the fonn of a vacation recommendation to the City Council. The Council will then hold the required <br />vacation hearing, with proper notice. <br /> <br />The map illustrating this easement will distributed at the meeting on April 11. <br /> <br />2.0 STAFF RECOMMENDATION <br /> <br />This is a record keeping issue that has no impact on the land use or the utility system.
