<br />traffic circle at the intersection of Chatsworth Street and Brenner
<br />Avenue be denied and ordering the $5,000, collected in 1997, to
<br />be refunded to those from whom it was collected. Roll Call, Ayes:

<br />R-PUD (Residential Planned Unit Development), with a
<br />underlying zoning of R-3 (General Residence District), ba
<br />the findings outlined in Section 3 of the Request for Council
<br />Action report, be approved. Roll Call, Ayes: Maschka, Mastel,

<br />Maschka moved, Mastel seconded, that the final R-PUD
<br />development agreement for the proposed Residential Planned
<br />Unit Development (R-PUD) to allow the construction of a 79 unit,
<br />three (3) story senior housing assisted care facility at 2555
<br />Snelling Avenue, be approved, and that the effective date of
<br />such planned unit development will not occur until after review
<br />and final approval by the City Attorney, and the placing of
<br />signatures on the planned unit development agreement and
<br />publication of the PUD ordinance, and that no new construction
<br />may occur before the effective date of the ordinance. Roll Call,
<br />Ayes: Maschka, Mastel, Wiski, Goedeke & Kysylyczyn, Nays:
<br />None.

<br />H-3 Mastel moved, Maschka seconded, that Resolution 9755,
<br />approving the indefinite extension of the request by
<br />Northwestern College, (PF3144) for FINAL approval of an
<br />amendment to PUD #1124 and approval of the FINAL PUD
<br />Agreement to continue the hearing indefinitely; and to instruct
<br />staff to provide written notice of the final hearing to property
<br />owners within 350 feet; and to publish notice in the official local
<br />paper. Maschka offered, and Mastel accepted a friendly
<br />amendment to change the extension and hearing from indefinite
<br />to July 10, 2000. Roll Call on the Mastel motion as amended,
<br />Ayes: Maschka, Mastel, Wiski, Goedeke & Kysylyczyn. Nays:
<br />None.
