Article 27 The site shall be maintained on a regular basis that is not detrimental to surrounding properties and the environment, and shall be maintained in a manner that sets a high standard. landscape materials are required to be maintained and replaced within three years of completion of a phase, except for the westerly buffer area which is addressed in Article 12 E. The outlot sites, prior to construction shall be maintained in a reasonable manner, including cut on a weekly basis during the growing season. The entire site, including the boulevard area along County Road E shall be maintained. All utilities shall be maintained in a manner that meets City requirements. The pond shall be maintained to meet storage and water quality requirements. Article 28 The Developer must secure all necessary review permits, water meters, etc. from the City and State agencies. Article 29 Minnesota Statutes, Chapter 505.02, Subdivision 1, has been amended. The Placement of durable iron monuments for marking of platted lots, blocks and boundaries must be set within one year of the recording of a plat or parcel and the City is required to check the ~. placement of monuments. The City has a contract with the Ramsey County Surveyor to do the field check. The Developer is required to reimburse the City for any costs from the County for placement of iron monuments. Ramsey County will estimate the cost and the City will inform the Developer of the estimated amount. The Developer will be required to escrow with the City, within ten days of being notified by the: City, the estimated cost for this field checking. Any difference in the actual charge and the Developer's escrowed amount must be resolved within 30 days of the City notifying the Developer. Article 30 Upon all plans and issues in this agreement being addressE..~, the City Administrative and Building Department staff will issue building permits. Article 31 It is anticipated that the two sit-down restaurants may need on-sale liquor licenses. The City will reserve two on-sale and one off-sale liquor licenses for this development until December 311 1998. Article 32 The above conditions are in addition to other existing City Code or other State or governmental unit regulations. Where articles of this Agreement are inconsistent with such codes or regulations, this Agreement will apply. ~', ". . \- -10-
