That provision specifies that an applicant may appeal the denial to the City Council by <br />filing a written appeal with the City Manager within ten (10) days of the denial. The City <br />Council is required to take up the appeal within thirty (30) days of the appeal. <br /> <br />Even if the time for appeal has lapsed, your client could modify the proposed site plan <br />and reapply. But obviously, if the proposed plan exceeds any of the established performance <br />standards, a variance or planned unit development process would be required. <br /> <br />At this time, City staff have not finalized materials for the February 22 work session. <br />We plan to present written information to the Council that addresses the history of the lot <br />coverage provision, the impact the provision has on the Shopping Center Districts currently in <br />existence, and alternatives for the Council to consider with regard to the provision.
