(PF3183) <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Bradley Operating Limiting Partnership is requesting the vacation of certain utility and <br />drainage easements in connection with the rerouting of utility lines located on the southeast <br />side ofHar Mar Mall, 2100 Snelling Avenue, and directly adjacent to the former HomePlace <br />structure (legal descriptions attached). <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Bradley Operating Limited Partnership is requesting the utility/drainage easement vacation <br />for the purpose of redeveloping the former HomePlace site with a 68,000 square foot Cub <br />Food grocery store. The proposal calls for a new utility easement to be established directly <br />adjacent the current easement and for the existing utilities to be reconstructed within said <br />new easement. Based on the proposed plan and the provision of a utility easement prior to <br />the relocation of utilities, the existing easement area identified on the attachment is no longer <br />necessary . <br /> <br />2.2 Section 1013.04 outlines the procedure for vacating streets, alleys, and easements. A public <br />hearing is required. The Planning Commission holds the hearing and recommends action <br />on the vacation request to the City Council. <br /> <br />3.0 STAFF COMMENTS <br /> <br />In reviewing this request, staff made the following [mdings: <br /> <br />3.1 The Roseville Engineering Department has reviewed, provided comments, and with the <br />addition of a manhole, approved the proposed design and plans to relocate public utilities. <br />They have determined there is no change in the capacity of the utility services, and only a <br />minor addition to the flow. As-built drawings will be required upon completion of the <br />relocation. The Engineering Department has also determined the proposed easement to be <br />adequate to accommodate the reconstruction of the existing utilities. All easement documents <br />must be recorded prior to the issuance of a certificate of occupancy for the new building on <br />the site. <br /> <br />3.2 The applicant (Bradley) is responsible for the full cost of vacating, moving, and <br />reconstructing the utilities. <br />
