i Welsch, Dennis

,From:
; Sent:
To:
Subject:

Driscoll, Margaret
Wednesday, January 19, 2000 12:12 PM
Sarkozy, Steve; Welsch, Dennis
FW: Against Har Mar Mall Vacation of Easement

Steve, I copied this message for council box 1/19/00,.. ,.Margaret

'-----Original Message-----
'From: Balczewski, Ron (STP) [mailto:ron.balczewski@guidant.com]
,Sent: Wednesday, January 19, 2000 10:18 ~1
'To: 'city.council@ci.roseville.mn.us'
Subject: Against Har Mar Mall Vacation of Easement

I am concerned about the request for a vacation of easement by the
'owners of
the Har Mar Mall. This request will be considered by the city council
during the January 24 meeting. Bradley Management wants to expand the
mall
,in order to support a new Cub Foods store and needs the vacation of
easement
in order to proceed. It seems to me that the Har Mar Mall is already
:overdeveloped and that allowing it to expand further would make the
:problem
worse.

Roseville city code states that no more than 25% of a property should be
developed. The question is how the developed percentage is calculated.
If
the land under Snelling Avenue and half of County Road B is included
then
the mall is
limit after
!calculation
:code
'is not clear as to whether or not this extra land should be included.
It
seems to me that the land under the roads is not usable and should not
be
included in the calculation.
Iland
lunder the roads and can not use the land under the roads. Why then
should
they be able to count this land as part of the lot used to support the
building?

just under the 25% limit (24.3%), and would be right at the
the expansion. If this extra land is not included in the
then the mall is already over the limit (28.5%). The city

Bradley Management is not taxed on the

I request that the council give guidance to the city staff as to how the
25%
development code should be interpreted such that only usable land is
included in the calculation.

Ron Balczewski
1391 Ryan Ave W.
Roseville, MN 55113
(651) 917-0391

1

v-f)..\~
\\'0\. \9-
9~
()J'"
