However, this movement of utilities and drainage is the first step <br />in the development of a proposed Cub Food Store and there is a very critical <br />unresolved issue here: <br /> <br />Does Bradley's proposal for the Cub Foods store exceed the amount of <br />development allowed by ordinance 1006.02 which states that "not more <br />than twenty-five percent (25%) of the lot area shall be occupied by <br />buildings?" <br /> <br />My neighbor, Mark Battis, brought up this issue at the Planning Commission Meeting <br />and provided some maps and calculations that indicate that the Har Mar Shopping <br />Center's current buildings are already at 28,5% of the property's total square footage. <br />It was discussed that there is more than one way to figure this total square footage <br />because of the complication of non-use easements on Snelling Ave. and County Road <br />8, It was reported that Bradley is using the entire width of Snelling Ave, and half the <br />width of County Road B in figuring Har Mar's total square footage! This is land which <br />can never be used for development or parking and on which Bradley does not even <br />pay taxes. In addition, Bradley may not be including the loading docks, storage areas, <br />the Ground Round, and Firestone in their calculation of building square footage. I <br />believe that Bradley's interpretations and calculations obviously do not meet the intent <br />of this ordinance. <br /> <br />Therefore, I am urging you and the other members of the City Council to <br />deny Bradley's request for vacation of utility and drainage easements <br />pending a determination of the current lot square footage and buildings <br />square footage at the Har Mar Shopping Center. <br />
