<br />2.1 Treat flags, regardless of communicative message, exactly the same as other signs or <br />communicative devices, subject to all size, location, and permitting requirements. This <br />approach is the most defensible from a constitutional perspective, in that it would be <br />content neutral and involve the least amount of judgment by enforcement officers of the <br />City. <br /> <br />2.2 Exempt all flags from the definition of signs, consequently allowing any number of flags, <br />with any message, to be displayed on any properties within the City. A complete <br />exemption from size, number, and permitting requirements may lead to a proliferation of <br />flags as "flexible billboards" and could result in additional lawsuits contrasting the City's <br />treatment of flags with the City's regulation of banners, pennants, etc. <br /> <br />2.3 Allow, in addition to other signage, the display of one flag per lot, irrespective of <br />message. <br /> <br />2.4 Allow, in addition to other signage, the display of any number of flags provided that any <br />flag that contains any commercial message that meets the definition of a business sign <br />would have to comply with the size, number and permitting requirements of the <br />ordinance. <br /> <br />3.0 BACKGROUND on ADMINISTRATION REQUEST <br /> <br />3.1 The City Code provides clear direction with regard to th.~ application process, review <br />procedures and appeal procedures, when variance, conditional use permit, and <br />subdivision approvals are involved. But the City Code is not sufficiently clear when <br />other types of permits or staff administrative determinations are involved. Most notably <br />is the city's recent experience with sign permitting and code interpretations. <br /> <br />4.0 STAFF RECOMMENDATION <br /> <br />4.1 Staff recommends the Planning Commission review and consider the attached draft <br />ordinance regarding amendments to Section 1009 ( sign regulations) and 1014 <br />(administration) of the Roseville Zoning Ordinance, as prepared by the City Attorney. <br />The recommended ordinance modifications will be forwarded to the City Council for a <br />first reading and their consideration on February 28, 2000. <br /> <br />Planning File #3190 (Sign Ordinance - Flag) 02/09/00 Page 1 of 2 <br /> <br />- <br />
