REQUEST FOR CITY COUNCIL ACTION

DATE: 01124/00
ITEM NO: 1-3
Agenda Section:
LAND USE

City ofRoseville request for City Code interpretation.

~f3-(9L

1.0 BACKGROUND

1.1 The Roseville staff is charged with administering the City Code. Part of this administration
includes the interpretation of many section requirements. In the event our interpretation is
challenged, a request is made to the City Council for a final determination regarding proper
administration of the City Code.

2.0 REVIEW of REQUEST

2.1 Mark Battis, Adrian Keller, and other residents adjacent to the eastern edge ofHar Mar Mall
have challenged the staff interpretation of Section 1006.02.C, Lot Coverage, of the Roseville
Zoning Ordinance.

2.2 Section 1006.02.C. states: Not more than twenty-five percent (25%) of the lot area shall be
occupied by buildings.

2.3 Staff interprets (underlining) Section 1006.02.C. of the City Code as follows: Lot Coverage:
Not more than twenty-five percent (25 %) of the shopping center master planned lot area
shall be occupied by the commercial building footprint which includes area within the
exterior walls of all commercial buildings. The "Master Planned" lot area includes the
main structure, all outlots, non-buildable pond, landscaping, setback, and buffer areas; all
principle commercial structures or accessory structures; and accessory parking and parking
structures within the legal description(s) of the site. The lot area must be defined within
a boundary survey completed by a state registered land surveyor. The boundary survey
must also include the square footage of all building footprints and the lot area in square
footage.

2.4 Staff has used this interpretation for a number of years as a measure of consistency
throughout the Shopping Center District.

3.0 REVIEW of ISSUE

3.1 The challenge has to do with what land area is used to determine whether a site conforms to
the 25% lot coverage requirement. Staff requires submittal by a Registered Land Surveyor
of a boundary survey of the legal description to verify lot coverage. A boundary survey does
not illustrate easements, exceptions, or road right-of-way dedications. It is the legal
description of record for a given parcel.

1
