<br />APR 2S '00 02:29PM PETERSON BELL CONVERSE <br /> <br />P.3/4 <br /> <br />Page 2 <br />04/25/00 <br /> <br />Like a peace officer, a code enforcement officer is entitled to apply for a search warrant to inspect <br />potential violations of the city code. <br /> <br />You will need to submit an application for all administrative search warrant along with a supporting <br />affidavit to receive the warrant. The affidayit and application need to set forth the alleged <br />violation(s) and the basis for your belief that such violations exist. Additionally, the administrative <br />search warrant should indicate that the purpose is to protec1 the public health, safety and welfare of <br />the citizens of Rosevil1e. <br /> <br />In order to obtain an administrative search warrant. you should do the following: <br /> <br />(1) .Prepare an application tor administrative search warrant and supporting affidavit, <br />then sign the affidayit in front of a Notary. <br /> <br />(2) You then take these documents, as well as a proposed administrative search warrant <br />to a judge, typically a judge at the Maplewood branch of Ramsey County District <br />Court. You should call Maplewood Court at (651) 777-2682/2651 for infonnation <br />regarding availability of a judge to sign the warrant. The staff at Maplewood Court <br />should be able to adyise you of an appropriate time to get the warrant signed. <br /> <br />(3) You would then present the application, affidavit and proposed administrative search <br />warrant to the judge. It is advisable to bring your file with you in case you Deed to <br />answer any questions the judge may have. <br /> <br />(4) Assuming the administrative search warrant is signed by a judge, then you can servc <br />it on a property owner and they would be required to allow you to enter the property. <br />The administrative search warrant should specitically state that the entry and <br />inspection would take place on a business day between the hours of 8:00 a.m. and <br />5:00 p.m., and you should obviously conduct the inspectioJ.1 only during these times. <br /> <br />Attached hereto is blank "fooo" administrative search warrant which you can use for these purposes. <br /> <br />If you haye any questions regarding this matter, please do not hesitate to conlact me. <br /> <br />Very truly yours, <br /> <br />JENSEN, BELL, CONVERSE & ERICKSON <br /> <br />Mitchell W.
