<br />~ <br /> <br />Findings: <br /> <br />1, The strict enforcement of the existing ordinance would not cause an undue <br />hardship on the applicant. Within the current lot coverage limitations, which <br />have a rational basis in providing additional buffer or separation between <br />intensive land uses and abutting properties, the applicant is still able to put the <br />property to a number of reasonable uses. <br /> <br />2. There is insufficient unique circumstances present to warrant a variance for <br />the proposed use. <br /> <br />3. As submitted and as subsequently modified by the applicant, and in spite of <br />the recently adopted design and performance standards for uses within the <br />Shopping Center Districts, the proposed expanded use would negatively affect <br />the character of the neighborhood due to the proximity of the development to <br />the residential properties abutting the subject parcel; the intensity of the <br />proposed use and orientation of the expansion toward the residential <br />neighborhood; and the traffic generated by the proposed expansion, <br /> <br />NOW, THEREFORE BE IT FURTHER RESOLVED BY THE city Council of <br />the City of Roseville, Minnesota, that the application to issue a Variance to allow the <br />construction of an additional 18,508 square feet of grocery retail, enclosed delivery and <br />enclosed trash area at the Har Mar Mall is hereby denied. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Council Member Mastel, and upon vote being taken thereon the following voted in favor <br />thereof: Wiski, Goedeke, Mastel <br />and the following voted against the same: Kysylyczyn <br /> <br />WHEREUPON said Resolution was declared duly passed and adopted on the 10th <br />day of April, 2000. <br /> <br />\ Wictoria\CommDev\Planning Files\3194 _Bradley Variance (Cub )\Resolution Denying V ar _ 041000.doc <br />
